We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the updated Terms.

Puff Count is designed to work completely offline, supporting your quit journey without requiring an internet connection for any core functionality.

3. Medical Disclaimer

The health timeline and recovery milestones shown in the app are based on general medical research and may not reflect your individual health situation. Individual results vary based on usage history, overall health, and other factors.

4. User Responsibilities

Acceptable Use

You agree to use Puff Count only for lawful purposes and in accordance with these Terms. You will not:

• Attempt to reverse engineer, hack, or compromise the app's security
• Use the app for commercial purposes without permission
• Redistribute or resell the app or its content
• Attempt to circumvent subscription or premium feature restrictions
• Use the app in ways that could harm yourself or others

Healthy Approach

Quitting nicotine is a personal journey. If you experience a relapse, the app supports you without judgment. Remember that many people quit successfully after multiple attempts. Be kind to yourself.

5. Intellectual Property

App Ownership

Puff Count, including its design, health milestones content, Crush Addiction game, icons, code, and features, is owned by Darkmaster's Pottery and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the app for personal purposes.

Your Data

You retain ownership of your quit progress, craving records, game achievements, and personal settings that you create within the app. This data is stored locally on your device and remains under your control.

6. App Functionality and Limitations

Limitations

• No Cloud Sync: Data is stored only on your device; we cannot recover lost data
• Device Storage: App functionality depends on available device storage
• Backup: Use iOS backup to preserve your data when switching devices
• Notifications: Reminders depend on iOS notification permissions
• Widgets: Home screen widgets require iOS permissions and may have refresh limitations

7. Privacy and Data

Your privacy is fundamental to Puff Count. Please review our Privacy Policy to understand our commitment to protecting your information.

• All quit progress and health data is stored locally on your device
• We do not collect, transmit, or access your nicotine usage or health information
• No account creation or personal information required
• No analytics, tracking, or advertising SDKs

8. Subscription and Premium Features

Subscription Terms

• All purchases are processed through the Apple App Store
• Subscription fees are charged in advance and are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage subscriptions through your Apple ID account settings
• Premium features remain accessible offline once your subscription is active
• Free tier includes 2 health milestones, 2 quit stages, Quick Tips, heatmap, widgets, and check-ins

9. Disclaimers and Limitations

Limitation of Liability

To the maximum extent permitted by law, Darkmaster's Pottery shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Puff Count.

10. Termination

We may terminate or suspend your access to Puff Count at any time for violations of these Terms or other reasonable causes. You may discontinue use of the app at any time by deleting it from your device.

Upon termination, your right to use the app ceases immediately. Since all data is stored locally, deleting the app will remove your quit progress, game achievements, and settings. Subscription refunds are handled according to Apple App Store policies.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of Puff Count will be resolved through binding arbitration or in courts of competent jurisdiction.
